Nobody is telling fundies to give up their beliefs in dog, Jeebus, and the Holey Goat. You can give up your church, convert to atheism (since we KNOW it is a religion of Satan, with Darwin as our Grand Omnipotent Dragon), or face the machine gun firing squad.
Your choice.

Hell, if we're going to go this route, we should force fundamentalists to get a BS in biology or go to jail.

I realize that most fundies are Baptists, but I hope this guy isn't. Why, BECAUSE ONE OF THE FUNDAMENTAL TENANTS OF BAPTIST THEOLOGY INVOLVES FREEDOM TO CHOOSE OR REJECT JESUS AS THE MESSIAH! Thank you.

On another note, do you really want to make people choose between church and jail? Sensible people would crowd the jails, it would be mass chaos, children would weep, moters would wail, and fathers would gnash teeth... or something like that madness.
In addition to the problems of a judge "giving a person a choice between going to jail or church" (to reduce excess verbage, this shall henceforth be refered to as "ordering"), I have a bit of a problem with the fact that the pastor of the church will be reporting back to the judge.
Yeah, a murder(reduced to manslaughter), shooting at a cop(reduced to illegal weapons possession), and now running from a cop, having to be tazered at capture. This piece of slime gets CHURCH?????? WTF?? If this were a liberal judge advising counseling by a licensed psychologist these fundies would bury him for "coddling criminals"! Once again I say WTF????

This is actually quite consistent with one of the main currents in analytical philosophy. Even if the externally-enforced choice were "cake...er...church or death", these philosophers would hold that the person being given the choice is still entirely free. After all, he can choose !
(This is part of why I'm rather more Continental. That and I don't get off on pretending that language functions entirely unlike language whenever you're calling your prose "philosophy".)
