If the husband or the wife has no more claim to the spouse's body than anyone else, then the marital vows are meaningless and the marriage is a charade. Once consent is withdrawn, the marriage has ended.

I don't know how your wedding vows went, but I certainly didn't promise my husband-to-be constant access to my body, in the chapel during our wedding.

There IS already a legal concept of marital rape, there's no need to attempt to create it.

Me and hubby managed perfectly well to "claim each other's bodies" long before we married.
We married to have the legal advantages, the inheritance laws, and to have a reason for a great party (and a spot of presents).

Our relationship and marriage is both of mind AND body; we like each others company, have similar interests, similar world-views (and he really likes my summerhouse on the West Coast, which I share with my siblings).

This may be true in some states, in that one cannot be charged with rape itself. But there certainly is such a thing as laws against assault and spousal abuse, without which rape is impossible. So it's still illegal - you just get 1 to 3 instead of 8 to 15.
