It isn't. Laws don't allow; they forbid. So he's asking the wrong thing. What he means is "why don't they make a law against it?"
As for same-sex marriage, that has nothing to do with homosexual sex. People, gay and straight, are going to continue having sex whether they're married or not, just as they always have. It's about financial and civil benefits.

Re. the differences in voting rights in the US & UK: Ah, I see. Well the House of Lords is somewhat different from Congress (ours is a Parliamentary democracy with a constitutional monarch, and all that jazz), but clergy can vote in the US? So much for 'Separation of Church and State' then. ;)
