Homosexuality does not, in and of itself, damage anyone's health.
Smoking, in and of itself, damages health (and I say this as someone who smokes a pack a day). It also damages the health of those who breath in your smoke unless you take care to smoke where others cannot do so.

The reason they regulate smoking has got to do with stuff like, if I'm a worker in a bar and have to be exposed to other peopel's smoke, that's not really fair, as it's proven to cause health problems. So it's banned to protect the workers. I don't see how gays provide the same threat.
