Since hate crime legislation exists in many states already, you'd think we'd have already seen examples of your "phony cases against Christians" scenario.

What is distressing is the things you people try to justify in the name of your religion, and I rightly hope you're brought up on hate crime charges if that leads you to committing an actual crime.
I know I can only speak for myself here and not my fellow atheists, but I can pretty much assure you that my issues with someone telling me I need Jesus (or any other mythological figure) will not end up in any level of the judicial system by simple virtue of the fact that I'll be too busy laughing at the people who would have me believe that....

Not in the US. The right to practice one's religion is protected by the First Amendment, unless the religion calls for things that are clearly detrimental to society, like child sacrifice or blowing up abortion clinics, or the religion appears to have been invented solely for the purpose of circumventing laws (e.g., marijuana "churches"). Even some Brazilian Christian sects that have traditionally used illegal hallucinogens like daime have been found to be protected.
My thinking about hate crimes is that if someone victimizes another for a category they fall into, that sets up a pattern. If someone thinks being black or gay is reason enough to beat someone, they're more likely to be a repeat offender than someone who just got drunk and was in a barfight. Therefore, harsher penalties are reasonable, and I'd recommend psych treatment be thrown in.

I think hate crime laws are dumb.
Hate crime laws are defined because we have a gradation of seriousness in our laws. Stealing a chocolate bar and stealing $50,000 have different penalties. And the intent (which is what the 'hate' refers to) is very important in the eyes of the law. Ignorance of the law is no excuse, but if you can prove ignorance of the facts, that makes a big difference. (If you can PROVE that you didn't know you were beating an innocent man, but attempting to stop a dangerous felon from escaping, the penalty is different, as it should be).

The legislation SPECIFICALLY SAYS it only applies to things that are already crimes, and that it doesn't allow for penalizing speech.
